SC / ST एक्ट संशोधन पर सवर्णों के बीच फ़ैलाया जा रहा ये झूठ

एससी एसटी एक्ट के 2018 के संशोधन के बारे में अनेक प्रकार से मिथ्या प्रचार किया जा रहा है, सही स्थिति निम्न प्रकार है-

एससी एसटी (अत्याचार निवारण अधिनियम) संशोधन अधिनियम, 2018 दिनांक 17 अगस्त 2018 को राष्ट्रपति के अनुमोदन तथा गजट में प्रकाशन के उपरान्त प्रभावी हो गया है- इस के द्वारा एक नई धारा 18-ए जोड़ी गयी है। इस में दो उपधाराएँ हैं।
  • उपधारा (1)(ए) में कहा गया है कि किसी भी व्यक्ति के विरुद्ध प्रथम सूचना रिपोर्ट दर्ज करने के लिए प्रारंभिक जाँच किया जाना अनिवार्य नहीं होगा।
  • उपधारा (1)(बी) में कहा गया है कि अन्वेषण अधिकारी के लिए इस अधिनियम में वर्णित किसी अपराध के किसी आरोपित व्यक्ति की गिरफ्तारी अनिवार्य होने पर इस अधिनियम अथवा दंड प्रक्रिया संहिता में वर्णित रीति के अतिरिक्त किसी अन्य प्रकार की अनुमति प्राप्त करने की कोई आवश्यकता नहीं होगी।
उपधारा (2) में कहा गया है कि धारा 438 दंड प्रक्रिया संहिता के अग्रिम जमानत के उपबंध इस अधिनियम के किसी मामले में लागू नहीं होंगे।

इस संशोधन का पहला परिणाम यह होगा कि इस अधिनियम के अंतर्गत अपराध घटित होने की सूचना मिलने पर यदि स्टेशन अधिकारी को यह विश्वास हो जाता है कि वास्तव में अपराध घटित हुआ है तो प्रथम सूचना रिपोर्ट दर्ज होने के पूर्व किसी तरह की प्रारंभिक जाँच की जरूरत नहीं होगी। जैसा की सभी सामान्य मामलों में होता है।
दूसरा यदि अन्वेषण अधिकारी को लगता है कि इस अपराध में किसी अभियुक्त की गिरफ्तार अनिवार्य हो गयी है तो वह किसी पूर्व अनुमति के बिना गिरफ्तारी कर सकेगा, जैसा की सभी सामान्य मामलों में होता है।
तीसरा इस मामले के दर्ज होने पर धारा 438 दंड प्रक्रिया के उपबंध प्रभावी नहीं होगा अर्थात अग्रिम जमानत का प्रावधान प्रभावी नहीं होगा। जैसे कि उत्तर प्रदेश में किसी भी अपराधिक मामले में अग्रिम जमानत प्राप्त करने का यह उपबंध प्रभावी नहीं है।
इस के अलावा जो भी प्रचार किया जा रहा है कि किसी को भी गिरफ्तार कर लिए जाने के बाद छह माह तक जमानत नहीं होगी आदि आदि सब मिथ्या प्रचार है।

The following Act of Parliament received the assent of the President on the 17th August, 2018, and is hereby published for general information:—
(1) This Act may be called the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2018.
(2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint.

  1. After section 18 of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, the following section shall be inserted, namely:—

“18A. (1) For the purposes of this Act,—
(a) preliminary enquiry shall not be required for registration of a First Information Report against any person; or
(b) the investigating officer shall not require approval for the arrest, if necessary, of any person, against whom an accusation of having committed an offence under this Act has been made and no procedure other than that provided under this Act or the Code shall apply.
(2) The provisions of section 438 of the Code shall not apply to a case under this Act, notwithstanding any judgment or order or direction of any Court.”
